1. Acceptance of Terms

Welcome to My Tenth Step. These Terms of Service ("Terms") constitute a legally binding agreement between you and My Tenth Step ("Company," "we," "us," or "our") governing your access to and use of our mobile application, website, and related services (collectively, the "Service").

By downloading, installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

My Tenth Step is a mobile application designed to support individuals in their personal growth and recovery journey. The Service provides:

• Daily Check-ins: Tools for tracking mood, gratitude, and daily goals
• Personal Inventory: Features for managing and processing personal inventory items
• AI-Powered Insights: Artificial intelligence-based suggestions and guidance
• Squad Communities: Private, encrypted group messaging with other users
• Progress Tracking: Tools for monitoring streaks, milestones, and personal growth

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Not have been previously suspended or removed from the Service

By using the Service, you represent and warrant that you meet all eligibility requirements. If you do not meet these requirements, you must not access or use the Service.

4. User Accounts

Account Creation

To access certain features of the Service, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Account Security

You are responsible for safeguarding the password and any other credentials used to access your account. We encourage you to use a strong, unique password and enable biometric authentication (Face ID/Touch ID) when available.

We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

Account Termination

You may delete your account at any time through the app settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

General Prohibitions

• Violate any applicable laws, regulations, or third-party rights
• Use the Service for any fraudulent or deceptive purpose
• Impersonate any person or entity, or falsely state or misrepresent your affiliation
• Interfere with or disrupt the Service or servers/networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use any automated system (bots, scrapers, etc.) to access the Service
• Reverse engineer, decompile, or disassemble any aspect of the Service

Community Guidelines

When using Squad features or any community functionality, you agree NOT to:

• Post content that is hateful, threatening, harassing, or discriminatory
• Share content that promotes violence, illegal activities, or self-harm
• Post spam, advertisements, or promotional content without permission
• Share personal information about others without their consent
• Engage in bullying, intimidation, or any form of abuse
• Share sexually explicit or inappropriate content
• Provide medical advice or claim to be a healthcare professional

We reserve the right to investigate and take appropriate action against anyone who violates these guidelines, including removing content, suspending accounts, and reporting to law enforcement when necessary.

6. User Content

Your Content

"User Content" means any content you create, upload, post, or transmit through the Service, including check-in entries, inventory items, notes, messages, and any other content.

You retain ownership of your User Content. By submitting User Content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you.

Content Responsibility

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not violate the rights of any third party
• Your User Content complies with these Terms and applicable laws

Content Encryption

Squad chat messages are encrypted end-to-end. This means that we cannot access the content of your private messages. You are solely responsible for the content you share in encrypted channels.

7. Subscriptions & Payments

Free and Premium Tiers

The Service offers both free and premium subscription tiers. The free tier provides access to core features, while the premium tier ("My Tenth Step Premium") offers additional features and benefits.

Subscription Terms

Premium subscriptions are billed on a recurring basis (monthly or annually, depending on your selection). By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel.

Payment Processing

Payments are processed through Apple App Store or Google Play Store, depending on your device. All payments are subject to the terms and conditions of the respective platform.

Free Trials

We may offer free trial periods for premium features. Unless you cancel before the trial ends, you will be automatically charged for the subscription.

Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation will take effect at the end of the current billing period. You will continue to have access to premium features until the end of the period you have paid for.

Refunds

Refund requests are handled by the Apple App Store or Google Play Store according to their respective policies. Please contact them directly for refund inquiries.

Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle after notice.

8. Intellectual Property

Our Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of My Tenth Step and its licensors. This includes, but is not limited to:

• The My Tenth Step name, logo, and brand elements
• App design, user interface, and user experience
• Software, code, algorithms, and technical implementations
• Documentation, graphics, and illustrations

The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

Restrictions

You may not:

• Copy, modify, or create derivative works based on the Service
• Sell, sublicense, or commercially exploit any part of the Service
• Use the Service to build a competitive product or service
• Remove any copyright, trademark, or other proprietary notices

9. Disclaimers

Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

No Guarantee of Results

We do not guarantee any specific results from using the Service. The Service is a tool to support your personal journey, but outcomes depend on many factors beyond our control.

AI Limitations

The AI-powered features of the Service are based on machine learning technology and may not always provide accurate, complete, or appropriate responses. AI suggestions should not be relied upon as professional advice. Always use your own judgment and seek professional help when needed.

Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY TENTH STEP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
• DAMAGES RESULTING FROM ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to defend, indemnify, and hold harmless My Tenth Step and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your User Content
• Your use of the Service
• Your violation of any rights of a third party

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and User Content
• Provisions of these Terms that by their nature should survive will survive (including ownership, warranty disclaimers, indemnity, and limitations of liability)

You may terminate your account at any time by deleting it through the app settings or contacting us.

Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation between the parties. Class Action Waiver

YOU AND MY TENTH STEP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will provide notice through the Service or by other means to give you the opportunity to review the changes before they become effective.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Tenth Step regarding the Service and supersede all prior agreements.

Severability

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemic, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
